ABSTRACT

The system of compensation for mental damages is an important part of civil law. With the development of social civilization and the strengthen of the idea of legal system, people pay much more attention to self protection and self respect self value and security as well. Compensation for mental damages has become the focus of the academic and practical circle.

Generally speaking, the system of compensation for mental damages is very young and there is still much deficiency although our current legislation began to regulate the problem of compensation for mental damages and the number of such legislation is growing, while the current legislation cannot adapt to such change， resulting in judges reaching different decisions in similar cases. Accordingly， more and more people hold that we should speed up the legislation on compensation for mental damages. Perfecting the system of compensation for mental damages is doubtlessly important for carrying out the idea of rule of law， promoting spirit civilization， refraining the tort act and protecting the lawful right of individuals and artificial persons.

There is a focus on three main headings. First, tell of the concept and  functional about the system of compensation for mental damages; The second ,tell of the phylogeny and legislative status about the system of compensation for mental damages, and analysis of our country in the civil and criminal justice hearing on the practice of the spirit of damages cases the problems. Last, there is the crux of the text that suggesting on extended extension, consolidated standard in the system of compensation for mental damages.
